Banking Ombudsman Scheme
The Banking Ombudsman Scheme, 2002 envisages the constitution of a review authority for settlement of disputes between banks and between banks and customers through arbitration. The scheme has instituted changes such as:

• Extension of coverage to regional rural banks in addition to commercial banks and scheduled Primary Co-operative Banks or Urban Banks.

• Designation of Deputy Governor–in–charge of Rural Planning & Credit Department (RPCD) of RBI as the reviewing authority for decisions taken by the Banking Ombudsman. Banks can request such a review only when an awa appears to be patently in conflict with its instructions and/or the law and practice relating to banking.

• Enabling the Banking Ombudsman to function as an arbitrator of disputes between banks and their customers and between banks. The value under dispute shall not exceed Rs.10 lakhs.

Revised Ombudsman Scheme, 2002 Effective from 14th July, 2002

The Ombudsman Scheme, 2002 has been revised to effect changes that empower the Ombudsman to:

i. Arbiter on claims up to Rs.10 lakhs

ii. Permit settlement by agreement, conciliation or mediation, or act as an arbitrator in disputes between a bank and its constituents and between a bank and another bank

iii. Call for information from the concerned bank

iv. Direct the bank, while passing the Award to take indemnity from the complainant for the amount involved
The aggrieved party can file a review to the prescribed authority under this Scheme. Response Times
a. An Award is not binding on the bank, unless the complainant furnishes the bank a letter of acceptance, within 15 days from date of receipt of copy of the Award.
b. The Ombudsman can grant 15 days more to furnish the letter or acceptance.
c. The concerned bank shall comply with the Award within one month from the date of receipt of letter of acceptance from the complainant, and also intimate the compliance to the Ombudsman.
d. If the Award is not acceptable, the bank can file an application as provided in clause 17 within one month from the date of receipt of the Award. Such review applications may be permitted only when the bank has obtained the written approval of its Chairman, Managing Director, or Chief Executive Officer. Further, no additional or new material of evidence will be permitted in such reviews. The reply for such reviews shall be filed within 2 weeks or within the time allowed. The reviewing authority can decide the issue, remand the matter to the Ombudsman, or issue a direction to implement the Award within 6 weeks.
